The Fashion Market Terms and Conditions

By booking and paying the stallholders fee, it is understood that you have read the Terms and Conditions of The Fashion Market and agree to abide by them.

The Dan O’Connell Pop Up Market is strictly for independent fashion and accessory designers who produce locally or ethically and sellers of quality preloved and vintage clothing for women and men.
Dan O'Connell Stall Details:

TRADER STALLS – Stalls are $85.  This fee includes insurance, advertising, a trestle table and chair.  Stalls are approximately 2.5 metres x 2 metres.
Stall space has provision for two garment racks and a trestle table per stall (single rail garment racks – no longer than 1.6 metres – no round racks)
OR you may have three garment racks and NO table.

The Fashion Market DO NOT supply or hire garment racks or equipment.  We like Shop for Shops’ racks, but you are free to bring the most suitable ones for your stall.   Do not bring your own tables & chairs.

RACK ‘N’ ROLL STALLS – Single rack only stalls are $65 each and includes the use of one rack that is supplied by The Fashion Market and the use of half a table (table is shared with your neighbour).
Single rack stalls are approximately 2.5 metres x 0.60 metres for the rack space – We use this classic black rack from Shop for Shops – Width 1.58m x Depth 0.51m.
You will also share a waist height table which is approximately 1.5 metres x 1.5 metres.

You are not permitted to bring additional racks. You may bring a mirror. You must provide your own coat hangers. Only one person per stall. These are ideal for people with a small amount of stock to sell.

Market Day Details:

Stallholder set up is from 10.00am. The market runs from 11.00am to 4.00pm. You are required to stay for the duration of the market. Pack up is until 5.00pm.

Venue Information

The Fashion Market does not supply or hire garment racks.

Single rail garment racks are preferred, no longer than 1.6 metres. No round racks are permitted. If you’re doing markets on a regular basis, it makes sense to invest in a quality garment rack.

Change Rooms:

There are communal change room facilities at all events hosted by The Fashion Market.

Stallholders can sell:

Your own designs which have been ethically produced. You will be expected to be transparent about your production techniques and sources.

Vintage and preloved collectors: Good quality, clean and well presented women’s and men’s garments and accessories. A few items of lower quality brands may feature in your collection but the majority of your stock must be from respected brands that have a higher resale value.

Genuine perfume is permitted to be sold. Fashion books can be sold.

Quality of Items for Sale:

All items you have for sale must be in good sellable condition. The Fashion Market has built a reputation for quality garments. If it’s not in a condition that can be worn, it cannot be sold.

Stallholders cannot sell:

Garments purchased from wholesalers that are not designed by you or your label. Children’s wear. New fur products. Replica or fake items. Underwear, gym wear or swimwear. Ripped, damaged or dirty garments and accessories. The majority of your stock must not consist of lower priced fast fashion brands. Anything that does not come under the category of women’s or men’s fashion or accessories. If you cannot wear it, you cannot sell it. *Fashion books are the only exception.

The Bendigo Fashion Market is strictly for independent fashion and accessory designers who produce locally or ethically and sellers of quality preloved and vintage clothing for women and men.
Bendigo Stall Details:

Bendigo Trades Hall stall fees are $85 each. This fee includes insurance, advertising, a small table (upon request / availability) and the use of a chair. Stalls are approximately 2.5 metres x 2 metres. Alternatively, you may supply your own small table.

BYO garment racks – The Fashion Market DOES NOT supply or hire garment racks.

The stall space has provision for two garment racks and a small table per stall (single rail garment racks – no longer than 1.6 metres – no round racks) OR you may have three garment racks and no table if you prefer. Please ensure that your merchandise stays within your allocated space.

The Geelong Fashion Market is currently strictly for sellers of quality preloved and vintage clothing for women and men.
Geelong Stall Details:

Geelong Deakin University Waterfront Campus stall fees are $85 each. This fee includes insurance, advertising and the use of a chair. Stalls are approximately 2.5 metres x 2 metres.

Ballarat Stall Details:

Ballarat Trades Hall stall fees are $85 each. This fee includes insurance, advertising, and the use of a chair. Stalls are approximately 2.5 metres x 2 metres.

The Fashion Market provides one single rack stall for Rack ‘n’ Roll stallholders only. Additional racks are not permitted.

Stall payment:

Payment for your stall is made at the time of your application via Paypal or Bank Transfer. Applications paid via direct bank transfer are required within 24 hours, using your order ID as the payment reference.

All applications will only be reviewed upon receipt of payment.

Please note this payment does not guarantee you a stall, your order has to be reviewed before approval, a refund will be issued should your application be rejected. Please be sure you want a stall before applying as refunds will not be given. You will receive notification about the success of your application within 72 hours.

Stall order approval / rejection:

Stall order approvals are at the sole discretion of The Fashion Market.  Should your application not be successful you will receive a refund via Paypal.  Unfortunately no further deliberation can be given to unsuccessful applications.

Refund Policy:

There are absolutely no refunds or market date transfers. If you are unable to attend your booked market date, you may transfer your booking to another trader no later than the Thursday before your market date. This trader must be approved by The Fashion Market first. Please notify us immediately of any changes to your stall booking.

Changes to Stall Bookings:

The Fashion Market reserves the right to change your stall selection or cancel your booking where necessary.

Market Cancellation:

Should The Fashion Market be cancelled due to emergencies, dangers, weather conditions, disasters, safety issues, health concerns, or other reasons that are not in control of the The Fashion Market organisers (as deemed by the The Fashion Market organisers), stallholders will not receive a refund.

Market Day Results:

Individual results vary at any given market. The Fashion Market takes no responsibility for stallholders’ success on the day.

Please also note the following banned sales, substances and activities:

Food (including fruit, jams etc.) or beverages of any kind, animals, cut flowers, poisonous products, prescription medications, illegal or offensive items, firearms, ammunition, explosives, weapons or dangerous goods of any kind, cigarettes/alcohol/drugs and illegal drug-related products, the sale of lottery, art union or raffle tickets, the conducting of any guessing game, lucky dip, chocolate wheel, side-show, competition, or game of chance is prohibited. Stallholders may not sell anything that may leak or contain fluids, nothing that may cause damage by being dragged across floors, no items that have legal restrictions upon their sale or disposal.

Market trading hours vary according to location:

It is your responsibility to make sure you are aware of the trading hours at the market event you are attending. All stallholders must stay for the duration of the Market. Please don’t book a stall if you can’t commit to the day and times required. Specific venue logistics and further information is emailed to stallholders on approval of their application.

Bendigo, Ballarat and Geelong – Saturdays 10.00am to 4.00pm

Dan O’Connells – Sunday 11.00am to 4.00pm

Shopping before the market opens:

As a stallholder you are there to sell your goods, however we understand that temptation is all around and you may wish to shop.  Please shop when the market opens to the public, there will be enough bargains for everyone!

On-selling of items:

Please do not buy goods from a stallholder and then on-sell it to the public for a profit on market day.  This is against the principle of The Fashion Market and stallholders identified doing this will be asked to leave immediately.

End of Market Day:

Please ensure at the conclusion of the market you leave your stall the way you found it. Place all recycling and rubbish in the appropriate bins.  Take any broken garment racks home with you.

Security:

Stallholders are responsible for their own stall security and monies.  No responsibility is taken by The Fashion Market for theft, loss or damage.

Safety:

Stallholders agree to set up their stall spaces in a safe and secure manner to ensure the safety of all shoppers. Exit Doors are to be kept clear at all times.

Floors:

When carrying your goods in and out of the venue, please take care not to scratch or damage the floors, as you will be liable for any damage caused.

Signage:

Stallholders can put signs on the walls using Blu Tack only, absolutely no sticky tape. Please remove and dispose of your signage at the end of the day.

Your marketing material:

You may hand out advertising or promotional material at your designated stall, such material must relate to the products on sale at your stall.  Please don’t spruik or place flyers on car windscreens etc.

The Fashion Market marketing and advertising:

The Fashion Market has an extensive e-news database and social media reach. We advertise online through Facebook, Instagram and Twitter, event listing websites and numerous other online directories. We do regular postcard drops, street posters and ad hoc advertising campaigns and conduct ongoing PR with local, national and international press.

Stallholder product images:

The Fashion Market reserves the right to use the product images of participating stallholders in our marketing material to promote the market event they are attending.

THE BORING BUT VERY IMPORTANT BIT:

The Fashion Market shall not be responsible for the compliance by a stallholder with any By-law, Regulation, Act or Statute. The Fashion Market accepts no responsibility for any transaction entered into in the Market enclosure. The Fashion Market will not refund stall hire fees paid in the case of cancellation of market due to factors out of our control. The Fashion Market reserves the right to decide or arbitrate any dispute arising out of or in the course of the conduct of the Market. The Fashion Market reserves the right to refuse admission to the Market to any person without giving any reason for the same and to eject or cause to be ejected any person and/or his/her goods and chattels without giving any reason for the same. The Fashion Market accepts no liability for the loss or damage of any kind suffered by any person who enters the Market area and all persons who enter the Market area do so at their own risk. The stallholder agrees to indemnify The Fashion Market against all claims for damages or injury to the property or person of any persons in respect of any claim by any such person arising out of negligence on the part of the stallholder or his agents.
